Access Terms and Conditions
1.
Services
Information Highway Inc. will provide services or assistance
in the Internet access on its computing and network systems
to individual account holders in exchange of payment of
fees, and in compliance with the terms and conditions of
this Agreement.
2.0 Use of services
2.1 - A Information Highway Inc. account is for individual
personal use only, and the account holder therefore agrees
to maintain a secure password for the account, and not to
share this password with anyone else.
2.2 - The account holder further agrees not to use
the Information Highway Inc. account for unattended automated
operations, or for multi-user applications, or server connectivity
applications.
2.3 - The account holder agrees to use the services
as permitted by local, provincial and federal law. The account
holder shall not use the services or carry out any business
activity or solicit performance of any activity that is
prohibited by law.
2.4 - The account holder agrees not to use the A
Information Highway Inc. site to obtain, reproduce or distribute
in any way, information, software or other material which
is protected by copyright, without obtaining permission
of the copyright owner.
2.5 - Information Highway Inc. reserves the right
to disconnect sessions after a predefined period of inactivity
and to restrict the length of sessions if required. The
account holder agrees not to use Internet applications for
the purpose of simulating network activity to avoid session
inactivity disconnection.
2.6 - The account holder agrees not to store more
than the limit of 2 Meg of data on his/her home directory.
A Information Highway Inc. will not permit users to exceed
this storage limit on its servers without charge.
2.7 - The account holder agrees that their account
may be terminated without notice if they use the account
for the purpose of "Spamming". For details on the generally
accepted definition of Spam, please visit http://spam.abuse.net/spam/
2.8 - The account holder acknowledges that A Information
Highway Inc. will terminate the account without notice,
if he does not comply with these terms.
3. Privacy
Information Highway Inc. cannot guarantee privacy to its
account holders. It is therefore recommended that this service
not be used for the transmission of confidential information.
Any such use shall be at the sole risk of the account holder,
and Yes IC Communications Inc. shall be relieved of all
liability in connection therewith.
4. Transactions on the Internet
Any purchase or transaction through the A Information Highway
Inc. site or the Internet will require the account holder
to divulge some personal information, credit card number
or other details of payment. The account holder agrees that
any information provided to a merchant or other provider
through the Information Highway Inc. site, will be accurate.
The account holder agrees to pay all charges incurred by
him or other users of his/her account and credit card or
other payment mechanisms at the prices in effect when such
charges are incurred. The account holder will also be responsible
for paying all applicable taxes, if any, relating to purchases
on the Information Highway Inc. site.
5. Confidential Information
The account holder authorizes Information Highway Inc. to
collect and retain, from any party, information relating
to his/her utilization of the Information Highway Inc. site,
and hereby authorizes any party to provide us with such
information. The account holder understands and agrees that
unless he notifies Information Highway Inc. to the contrary
by E-mail, he further authorizes Information Highway Inc.
to disclose, on a confidential basis, to any party with
whom Information Highway Inc. has business relations, all
information relating to his/her dealings with us and the
Information Highway Inc. site. A file for each account holder
will be kept at Information Highway Inc.'s Toronto head
office which the account holder may access at any time.
6. Indemnity
The account holder agrees to defend, indemnify and hold
Information Highway Inc. harmless from any and all liabilities,
costs and expenses, including reasonable attorney's fees,
resulting from the account holder receiving Information
Highway Inc. services which cause direct or indirect damage
to another party.
7. Trademarks
Information Highway Inc. Inc., logos and icons identifying
Information Highway Inc.'s services referenced herein are
trademarks or registered trademarks of Information Highway
Inc.. All other product and/or brand or company names mentioned
herein are the trademarks of their respective owners.
8. Territory
The Information Highway Inc. site is only offered in Canada
and the United States.
9.0 Payment of fees
9.1 - The account holder will pay A Information Highway
Inc. a fee, as set out in the Information Highway Inc. dial-up
price list.
9.2 - The Information Highway Inc. accounting cycle
charges on a period based on signup terms.
9.3 - All payments for services will be submitted
in advance of receiving services.
10.0 Account Renewal and Termination
10.1 - Accounts shall be automatically renewed for
successive terms on the expiry of the initial and each successive
term unless the account holder or Information Highway Inc.
gives the other party notice in writing of the termination
as hereinafter provided.
(a) if the account holder fails to pay for the use
of the Information Highway Inc. services or fails to pay
any other amount owed to Information Highway Inc. in accordance
with its invoice terms, Information Highway Inc. may terminate
its services without notice to the account holder;
(b) the agreement may be terminated by either party
upon 30 days written notice. In the case of the account
holder, notice shall be directed to the address provided
on the account holder file.
11.0 Miscellaneous
11.1 - This agreement shall be governed by and construed
in accordance with the laws of the Province Britich Columbia,
and any legal action regarding the Agreement shall be brought
in the Courts of the Province of British Columbia and the
parties hereto hereby attorn to that jurisdiction.
11.2 - Furthermore, upon notice published on line
by Information Highway Inc. services, the above terms and
conditions may be modified, prices for services may be changed,
as well as services may be discontinued or changed.
11.3 - If the account holder is not satisfied with
the Information Highway Inc. operations, or with these terms
and conditions, policies and practices, his/her sole and
exclusive remedy is to discontinue using the Information
Highway Inc. site. The account holder will please notify
our Accounting department at 416-622-6614 Ext 201 to initiate
a closure of his/her account.
12.0 Connection
12.1 Due to Bell Canada's networking capabilities
within your local telephone exchange, and connecting lines.
We are unable to gaurantee modem speeds. However we
can gaurentee that our equipment is capable of giving you
a connection speed to which your modem has been manufactured
to supply. (i.e 2400 --> 56000).
